$1.5 Million Verdict for Mesothelioma Victim’s Family Stands Up to Appeal

A mesothelioma diagnosis is the start of a very long and challenging road. It leads to expensive medical treatments that are often far beyond a family’s means. The case involved William Saller, who died of mesothelioma in 2006 after having spent 8 years working for Standard Oil Company between 1959 and 1967.  A trial held in 2013 found Crown Cork & Seal Company liable for Saller’s death and awarded his widow and two adult daughters $1.365 million in noneconomic damages and $131,543.22 in economic damages. They jury also awarded the family members $3.6 million in punitive damages. Crown Cork appealed the judgment based on an assertion that the court had not provided proper instructions to the jury. They also appealed the punitive damages as being based on a flawed interpretation of facts.

Upon reviewing the case, the Court of Appeals of California found that there was substantial evidence to support the jury’s finding of guilt. Crown Cork had based their appeal on testimony provided by another Standard Oil employee, who had testified that the company had been aware of the dangers of asbestos and had provided respirators for workers. But other testimony contradicted him regarding the use of respirators at the facility where Saller had worked, leading the jury to decide that no such protections had been provided to him. The appeals court did, however, agree with Crown Cork’s assertions regarding the punitive damages award, and that was removed, living the family with $1.5 million in damages.
