Hennessy’s attorneys asked for – and received – a summary judgment ruling dismissing the case because Hennessy’s equipment did not contain asbestos.

Mr. Rondon died of his mesothelioma, and the motion for summary judgment was appealed by his widow on the basis that the grinders had contributed to his exposure to asbestos because their “inevitable use” was to grind asbestos-containing brakes. Though Hennessy’s attorneys argued against this, pointing out that the equipment was also used to grind brakes that did not contain asbestos, the Rondon’s mesothelioma lawyer brought in an expert witness to testify that prior to 1980 when Rondon had done his work, “virtually all” drum brake materials contained asbestos, and further that beginning in 1973 Hennessy had provided an asbestos dust collector bag as a standard piece of equipment along with their grinder. The appeals court overturned the original decision and the case will now go to trial, where the Rondon family can have their story heard by a jury.
