Oregon Jury Awards $5 Million to Asbestos Victim Diagnosed with Mesothelioma

Charles “Chuck” Eastridge began working at a planer mill in Philomath, Oregon back in 1969. His job made him responsible for the maintenance of the mill’s equipment, including the kilns and boilers, and that meant occasionally replacing gaskets that were contaminated with asbestos. It wasn’t until 1980, eleven years later, that he learned of asbestos’ dangers, and at that point he took self-protective action to try to minimize the amount of asbestos dust that he was exposed to. Unfortunately, it was too late. He worked for the plant for another twenty years, and in 2014 he was diagnosed with malignant mesothelioma. He sued Mar-Dustrial, the company that supplied the gaskets, and this week was awarded $5 million in damages by a Portland, Oregon jury.

The jury heard testimony from Eastridge about the clouds of asbestos dust that were raised as he worked with the gaskets. They also heard Mar-Dustrial’s argument that the mill where Eastridge worked was not a client because they were too far away from their home office, and heard expert testimony about the impact of asbestos exposure on the human body. Mr. Eastridge explained that prior to his diagnosis he had led an active, healthy life, working out at the gym and spending time with his wife. In recent days he has undergone chemotherapy and surgery to battle the disease, but his quality of life has been dramatically changed and at the time of trial he had entered hospice care.

After listening to all of the evidence, the jury determined that Mar-Dustrial was responsible for both negligence and strict liability and decided in favor of Eastbridge. They awarded him $3.25 million for the suffering and pain that he was forced to endure and another $1.75 million to the couple for loss of consortium.
