Philadelphia Carpenter Awarded $6.4 Million for Asbestos Exposure

A jury in the city of Philadelphia spent six days listening to testimony in a case pitting a carpenter who worked for PECO, the local electric company for thirty years, against two companies that supplied PECO with products containing asbestos. William Roverano was diagnosed with lung cancer late in 2013, and though he admitted to smoking cigarettes for thirty years, his physicians concluded that his illness was caused by exposure to the defendants’ products.  The jury agreed, and awarded him and his wife Jacqueline a total of $6.4 million.

The Roveranos suit named both John Crane, Inc. and Brand Insulation, Inc. as defendants, though their initial complaint was registered against additional companies that settled for undisclosed amounts. John Crane manufactured packing material laced with asbestos and Brand Insulation supplied and installed thermal insulation.  Roverano claimed that when he was working as a carpenter for the electric company, he was constantly exposed to turbines, generators, boilers, gaskets, pipe coverings and packing materials, all of which contained asbestos.

Roverano admitted that he had smoked from 1967 through 1997, and his medical experts indicated that both the smoking and the defendant’s products had led to his cancer, which metastasized from his lungs into his brain. The defendants argued on a number of fronts, stating that the cancer could not be related to asbestos because there were no other underlying medical conditions typical of exposure to the toxin They also indicated that his exposure to asbestos in their materials was not sufficient to have caused him health problems. According to Roverano’s attorney, “The defense did everything they could to bring in their experts from all over the country to challenge his exposure.”

After six days of testimony, the jury came back with an award of $5.2 million for Roverano and another $1.25 million for his wife’s loss of consortium claim. Despite the extensive expert witness testimony provided by the defense, they sided with the local couple. Their attorney said, “Mr. and Mrs. Roverano were lifetime South Philadelphia residents. He’s a local guy, born and bred, and they were very credible witnesses regarding his exposure.”
