The president and chief executive officer of NAI Plotkin, a real estate development company, has settled his mesothelioma claim against the maker of Clubman Talc. His attorney indicated this move should shorten the days needed for his upcoming jury trial. Johnson & Johnson and several of its related companies are among the remaining defendants.
Man Blames Mesothelioma on Lifelong Talcum Powder Use
Evan Plotkin’s mesothelioma lawsuit against Johnson & Johnson and other talcum powder products was scheduled to begin in Connecticut state court on September 10th and was expected to last through the end of October. The amount of his recently announced settlement with the company that owns Pinaud Clubman talcum powder remains undisclosed, but his attorneys have mentioned that the agreement should reduce the number of witnesses and eliminate several pretrial motions, thus cutting days off the time needed for the trial.
Mr. Plotkin’s mesothelioma lawsuit claims he was exposed to asbestos “at various times in his life, from approximately the 1950s through approximately the 2000s, through his personal use of asbestos-containing talcum products on himself and on his children,” as well as “through his personal use of art and craft supplies as an artist and sculptor.” His product liability claim accuses the companies of strict liability, negligence, failure to warn, and breach of warranty. It also cites recklessness, fraudulent misrepresentation, and conspiracy, and adds accusations against Johnson & Johnson of fraud and violations of the Connecticut Unfair Trade Practices Act.
Judge Asks Victim and Talc Companies to Resolve Outstanding Issues
Though the settlement with the successor to Clubman Talc will eliminate one named defendant, the judge hearing the case noted several issues that remain outstanding, and asked the parties to “narrow the universe of outstanding issues.” These include Johnson & Johnson needing Mr. Plotkin’s most recent medical records and Mr. Plotkin’s attorneys needing testimony from Johnson & Johnson about the company’s recent restructuring.
