California Couple Blames Dozens of Companies for His Mesothelioma

Last month, Joseph B. Hunter, Jr. and his wife Claire filed a personal injury lawsuit blaming multiple companies for his mesothelioma diagnosis. According to the couple’s claim, dozens of companies including American Biltrite, Carrier Corporation, General Electric, and Kaiser Gypsum negligently and carelessly made, sold, or distributed asbestos-containing products that they knew were dangerous to use.

Mesothelioma Victim Was Shipyard Worker and Electrician

According to the couple’s claim, Mr. Hunter’s mesothelioma was caused by exposure to asbestos while working in two different professions: From 1964 to 1980, he was employed at Todd Shipyard in San Pedro, California, working with and around others working with asbestos and asbestos-containing products, and in the early 1970s he worked as an electrician on numerous job sites in Southern California.

With the first half of his career spent working in a shipyard that was heavily contaminated with asbestos and the last half of his career working on HVAC systems that made significant use of asbestos-containing parts, the couple point to the many companies that negligently placed the products into the market, many of which they accuse of being aware of the dangers those products posed to human health.

Multiple Charges Against Asbestos Companies Named in Mesothelioma Lawsuit

The Hunters’ mesothelioma lawsuit cites several causes of action against the asbestos companies named, including negligence, strict liability, negligent misrepresentation, fraud by non-disclosure, and loss of consortium. In response, at least one of those companies – Greene Tweed — filed a petition for the claim to be removed to federal court based on the company having been a government contractor following the specifications of the United States regarding parts used in U.S. Navy vessels. The company and the couple are awaiting the court’s decision on this question of jurisdiction.
