Though the presentation of evidence took three weeks, it took a New York state jury just 45 minutes to return a $15 million verdict to a mesothelioma widow seeking justice for her husband’s death. The jury found that asbestos company Kaiser Gypsum acted with reckless disregard leading to the death of 69-year-old Munir Seen.
Asbestos Exposure Led to Malignant Mesothelioma
According to evidence presented during the mesothelioma trial, Munir Seen worked at a variety of construction sites in both New York and New Jersey throughout the 1960s, 1970s, and 1980s. Much of the work that he did required combining Kaiser Gypsum’s asbestos-contaminated joint compound with water, mixing it into a paste to be used in putting up drywall sections.
In addition to breathing in asbestos fibers from the dust raised by the joint compound powder, the mesothelioma victim’s risks were increased when, after the product dried, he sanded it down to create a smooth surface. Inhaling asbestos fibers has been directly tied to the development of the deadly form of cancer.
Mesothelioma Victim’s Family Recalls Pursuit of American Dream
Mr. Seen’s family’s attorneys went beyond proving that Kaiser Gypsum had acted with disregard for safety in selling a joint compound that contained asbestos. They also personalized the mesothelioma victim for the jury, recounting how the construction worker had immigrated from Jordan in the late 1960s in search of the American Dream and providing a good life for his family.
After experiencing shortness of breath in 2016, Mr. Seen was diagnosed with malignant pleural mesothelioma. Though he worked for a short period after his diagnosis as a security guard, his illness forced him to take early retirement and he died three years later. His death he left his wife, four grandchildren, and two adult children who recalled him as a “best friend” and “the source of wisdom in my life.”
