Massachusetts Vet Blames Naval and Non-Naval Asbestos Exposure for Mesothelioma

Last February, Robert Spiro and his wife Nancy filed a mesothelioma lawsuit against multiple companies for their negligence in exposing him to asbestos and failing to warn him of its dangers. Their personal injury claim also singles out Metropolitan Life Insurance Company, accusing them of a conspiracy to withhold, alter, suppress, and misrepresent information about the health effects of asbestos exposure in concert with Johns Manville Corporation and/or Raymark Industries.

Mesothelioma Victim Cites Navy Service and Occupational Exposure to Asbestos

According to the couple’s claim, the mesothelioma victim served in the U.S. Navy as a machinist mate aboard the USS Coolbaugh from approximately 1957 to 1959 and aboard the USS Newman K. Perry from approximately 1959 to 1960. He also worked as a heating products salesman from approximately 1976 through the end of the 1970s. 

Mr. Spiro blames his mesothelioma on exposure from both his naval service and the years thereafter when he was exposed to asbestos, inhaling and/or ingesting its dust, fibers, and particles that came from the asbestos or asbestos-containing products that he worked with.  The couple specifies that the defendants were responsible for both non-naval exposure and naval exposure, noting that the companies had a duty to use and exercise reasonable and due care and that they had breached expressed and implied warranties. The couple is also seeking compensation for the loss of consortium for Mrs. Spiro.

Insurance Company Accused of Conspiracy in Mesothelioma Lawsuit

In addition to the negligence claim against the asbestos companies, the mesothelioma victim and his wife single out the Metropolitan Life Insurance Company, accusing them of engaging in a conspiracy to inflict injury by remaining quiet about the health effects of asbestos exposure and about the results of scientific studies and tests of asbestos workers. They claim that the company published “intentionally false, misleading, inaccurate, and deceptive information about the health effects of asbestos exposure,” suppressing medical inquiry and understating information about the mineral’s hazards.
