Mesothelioma Victims’ Families Reach Settlement with Asbestos Company

While many other defendants remain, the families of two Dupont plant employees who died of malignant mesothelioma have reached a settlement with Armstrong International.

Former Dupont Plant Workers Died of Malignant Mesothelioma

Both Augustus Adams and Clarence Hales died of malignant mesothelioma years after having worked at a DuPont facility in Kinston, North Carolina between the 1950s and 1980s. Both men’s families filed suit against multiple defendants whose asbestos-contaminated products they were exposed to at the plant, and though they’d worked in different areas of the plant, their families had tried and failed to consolidate their cases in pursuit of efficiency.

The men’s families are both represented by the same mesothelioma attorney, and though they were denied the ability to combine their cases in court, they continue to work together outside of court. Those efforts have been rewarded by reaching a settlement with Armstrong International. Though the details of the agreement are confidential, a representative for both families said that they are both “appreciative of everyone’s efforts to find a way to resolution.”

More Defendants Remain in North Carolina Mesothelioma Claims

While resolving their issues with Armstrong International is a step in the right direction, the mesothelioma victims’ families still have a long legal road ahead of them, as several more defendants remain, including Dow Chemical Company, Fluor Enterprises, Inc., and Viking Pump, Inc.  The last of these had filed a motion for summary judgment to have the case against them dismissed, but later withdrew that motion. 

The original mesothelioma lawsuits were filed by the two families in 2021, and the settlement agreement with Armstrong may signal more to come.
