Nebraska Family Agrees to $260,000 Settlement After Sister’s Mesothelioma Death

Two years after Donna Grant died of malignant mesothelioma, the city of Lincoln, Nebraska has reached a settlement that will pay her family members $260,000 for her hospital and medical bills, her burial and funeral costs, the pain and suffering she experienced prior to her death, and her family members’ sorrow after her passing.

Mesothelioma Blamed on Asbestos in Popular Entertainment Venue

The original lawsuit seeking compensation was filed by Ms. Grant’s sister, who blamed asbestos in the walls and ceilings of the Pershing Center for her sister’s malignant mesothelioma. According to Dixie Johnson, Donna Grant had worked in the popular entertainment venue for decades, starting in 1974 and continuing into 2014, when the structure was no longer hosting events.

Malignant mesothelioma is caused by exposure to asbestos, and Mrs. Johnson provided evidence that her sister’s work in the concessions and catering areas of the venue took her throughout the building. Over the years she inhaled asbestos disturbed by maintenance crews and patrons, as well as asbestos fibers shaken loose when the building vibrated during concerts.

Mesothelioma Lawsuit Accuses City of Negligence in Managing Asbestos in Building

In seeking compensation for her sister’s treatment and the pain her mesothelioma caused, Dixie Johnson asserted that the city of Lincoln, Nebraska had been negligent in their management of asbestos in the building. She claimed that they should have tested for asbestos in areas where employees risked exposure, and that they should have taken more care in the hiring and supervision of subcontractors who would be working with asbestos-contaminated materials.

With the issue of Ms. Grant’s mesothelioma compensation resolved, the city still needs to address the asbestos contamination in the Pershing Center building. They have hired an asbestos remediation firm to do work prior to its demolition.
