Volkswagen Ordered to Pay $5.75 Million in Mesothelioma Damages

It’s been just over two years since Thomas Sorrentino was diagnosed with malignant mesothelioma, and February will mark the two-year anniversary of his death from the rare and fatal asbestos-related disease. Fortunately, he was able to give a deposition a few days before his death, and the testimony he provided was invaluable to the King County, Washington jury that just awarded his estate and his son $5.75 million in damages from Volkswagen Group of America and Volkswagen AG.

Mesothelioma Victim Worked for Volkswagen for Three Years

The jury found Volkswagen AG of Germany and its American subsidiary Volkswagen Group of America negligent and responsible for having exposed Mr. Sorrentino to the asbestos that caused his malignant mesothelioma. The exposure took place between 1972 and 1975 when he worked as an auto mechanic at a Spokane Volkswagen dealership. 

According to the mesothelioma victim’s testimony, he was responsible for replacing brakes and clutches on Volkswagen vehicles when he worked for United Volkswagen in Spokane, Washington. He recalled using a grinding machine that sent asbestos dust flying into the air as he worked to make the contaminated brakes fit the brake drum. He also recalled an air compressor that he used to blow brake dust away. Both actions led to asbestos fibers floating in the air, which he subsequently inhaled and which led to the development of his cancer. 

Volkswagen Acknowledges Lack of Warning on Replacement Brakes

The jury heard evidence in the mesothelioma lawsuit indicating that Volkswagen had been aware of the dangers of asbestos. Testimony revealed that after having tested for the mineral at its factories in Germany, it had provided protective gear and clothing to its employees there. But despite this knowledge, it took no similar steps to protect mechanics working in other countries. 

This lack of action meant that Mr. Sorrentino had no opportunity to protect himself from being sickened by mesothelioma or other asbestos-related diseases. The jury determined this to be negligent and awarded his estate $5 million. His surviving son was awarded $750,000.
