Though the news is filled with reports of asbestos being identified in Johnson & Johnson’s Baby Powder, the company’s talc-based product is not the only one being accused of causing malignant mesothelioma in consumers. There have also been cases filed against Colgate-Palmolive, Avon, and other companies, all of which have been accused of knowing that their talc products were contaminated with the carcinogenic material and continuing to sell it to the public without warning of the risks. Last month New York’s Supreme Court Judge Manuel J. Mendez refused to grant Colgate Palmolive summary judgment in one of these cases, allowing the family of a man who died of mesothelioma to continue to seek justice.
Family Testifies About Extensive Use of Colgate-Palmolive Product
The mesothelioma lawsuit that is being pursued in New York was filed by the family members of Edward Rothlein, who died of the rare and fatal form of cancer in October of 2018. Mr. Rothlein’s family has accused Colgate Palmolive Company of failure to warn of the dangers of their Cashmere Bouquet talcum powder product.
In a deposition that took place a year before his death, the mesothelioma victim reported that he had personally used the product after having gotten married, but that the majority of his exposure came from his wife’s extensive use of the product. He described her as a “powderholic” and said that they would fight about the mess from the powder that she left behind in their bathroom, as well as on the sheets of their bed.
Mesothelioma Victim’s Widow Remembers Clouds of Cashmere Bouquet Powder
The mesothelioma widow also testified about the use of the powder, saying that when she used it she “made the whole room look like a smoke screen” and saying that her husband complained about it for years.
Despite the testimony about Mr. Rothlein’s extensive exposure to the talcum powder product, attorneys representing Colgate Palmolive moved to have the case dismissed, saying that there was no proof of a connection between their product and Mr. Rothlein’s mesothelioma. The judge denied their motion and the case will be able to move forward
