Jury Awards $39 Million After Talc Used in Medical Procedure Leads to Mesothelioma

In a first-of-its-kind mesothelioma claim, a couple accused a talc supplier’s asbestos-contaminated talc of causing his fatal illness. After a three-week trial, a Massachusetts jury has ordered Cimbar Performance Minerals to pay Bryce and Diane Zundel over $39 million in damages.

Talc Used in Pleurodesis Procedure Led to Mesothelioma

According to testimony presented during the three-week mesothelioma trial, Salt Lake City, Utah, native Bryce Zundel underwent pleurodesis in 2014 for treatment of a collapsed lung. Pleurodesis can be performed in different ways, but when talc is used, the substance is inserted between the linings of the lung and chest wall to make them stick together. This seals the space and limits further fluid or air buildup. Seven years after his pleurodesis, Mr. Zundel was diagnosed with pleural mesothelioma that his physicians trace back to asbestos contamination of the talc that was used during the surgery. 

Following his mesothelioma diagnosis, the Zundels conducted research that determined the talc used during his pleurodesis procedure had been supplied to the Salt Lake City hospital by Boston Medical Products, which purchased it from Georgia-based Cimbar Performance Minerals.  Cimbar had sourced its talc from China, from a mine known to be cross-contaminated with asbestos.

Expert Witnesses Impact Jury’s Decision in Mesothelioma Trial

Several experts provided compelling testimony that supported the mesothelioma victim’s case, including witnesses who explained how asbestos impacts cells, how asbestos can contaminate talc, and the journey that mesothelioma patients experience.

The jury also heard extensive testimony about the impact that mesothelioma has already had on Mr. Zundel, including leaving the once active and healthy 64-year-old with only 10% lung capacity on one side and an almost certain painful death in the near future. The $39 million mesothelioma verdict allocated $12.25 million for Mrs. Zundel for loss of companionship and support.
