Talc pleurodesis is a medical procedure that is used to prevent the build-up of fluid or air in the pleural lining. It provides relief to patients suffering from several lung conditions, including malignant pleural mesothelioma, but in the case of Salt Lake City, Utah resident Bryce Zundel, the talc used in the procedures he underwent in 2014 and 2020 was what caused his diagnosis with the fatal disease.
Lawsuit Blames Mesothelioma on Asbestos in Medical Talc
Over the last several years, thousands of personal injury and wrongful death lawsuits have been filed against cosmetic and commercial talc manufacturers and suppliers by people diagnosed with malignant mesothelioma and ovarian cancer. The victims have accused these companies of negligence for failing to warn about asbestos in their products, and of supplying defective products that cause harm.
In Mr. Zundel’s mesothelioma lawsuit, the talc at issue was administered intrapleurally around his left lung during two separate talc pleurodesis procedures that took place in 2014 and 2020. According to the claim filed in a Massachusetts state court, in September of 2021, he was diagnosed with malignant pleural mesothelioma. The lawsuit states that his physicians observed “talc aggregations covering most of the lower lobe surface as well as the posterior parietal pleura, diaphragmatic surface, and pericardial surfaces.”
Mesothelioma Victim Sues Talc Company
The mesothelioma victim’s lawsuit names Amerilure, Inc., Boston Medical Products, Inc., and Cimbar Performance Minerals as defendants, as well as Lymol Medical Corporation and Sciarra Laboratories. Together, the defendants are suppliers, packagers, marketers, and distributors of the asbestos-containing talc, as well as miners and testers of the product. The suit accuses them of negligence in their duty to use and exercise reasonable and due care as well as to provide detailed and adequate warnings about the dangers of their products.
The lawsuit is seeking compensation for the impact of Mr. Zundel’s mesothelioma including medical expenses, dramatic reduction in his life expectancy, mental and physical pain and suffering, and impairment in enjoyment of life.
