After a lifetime of using talcum powder products on herself and her children and using the product in her work as a nursing assistant, New Hampshire resident Stephanie Pelley was diagnosed with malignant mesothelioma. She has filed a personal injury lawsuit against Vi-Jon, LLC, the Missouri-based company whose asbestos-containing talc she blames for her fatal illness.

Ms. Pelley’s case was filed this past June, approximately three years after she was initially diagnosed with malignant mesothelioma. According to her filing, the lifelong New Hampshire resident was exposed to asbestos-containing talc products from the time she was born until her diagnosis, using it personally and on her children. She was also exposed to the product through the use of talcum powder products by others in her household.
In addition to the asbestos-containing talc the mesothelioma victim was exposed to within her household, she also points to occupational exposure to asbestos from having used various talcum powder products on the patients she cared for as a licensed nursing assistant in various nursing home and hospital settings from approximately the mid-2000s to the mid-2010s. There was also talcum powder contained in the powdered latex gloves she wore while caring for patients.
Talc Company Accused of Knowing that Asbestos in its Talc Could Cause Mesothelioma
The mesothelioma victim’s personal injury case notes that Walgreens baby and body talc powders were among the products that contained Vi-Jon’s talc. It notes that these products were designed, advertised, marketed, and sold as being suitable for this type of household use, and that other products containing its talc would be sold for use by medical professionals, such as herself.
The claim states that talc companies, including Vi-Jon, knew, or should have known from long-available scientific reports, that relatively low cumulative doses of asbestos exposure, including from inhaling asbestos-containing talc, can and do cause mesothelioma. She is accusing the company of negligence, strict liability, failure to warn, breach of express and implied warranties, gross negligence, and fraudulent concealment and is seeking compensation for the damages she has already suffered and will continue to incur in the future.
