After the mesothelioma death of their father, Emanuel J. Bourgeois, Errol J. Bourgeois, Sr. and Mary Anne Bourgeois Richardson filed a wrongful death claim against Avondale Shipyard, as well as the shipyard’s insurers and other companies they blame for having exposed him and several of his family members to the asbestos that caused his fatal illness. The mesothelioma claim was filed in the United States District Court of the Eastern District of Louisiana. It explains the many ways that Mr. Bourgeois was exposed to asbestos as Avondale’s long-time employee, holding various positions at the shipyard between 1963 and 2005.
The mesothelioma claim also points to Mr. Bourgeois’ secondary exposure to asbestos carried on the person and clothing of other Avondale workers riding to and from the worksite, and through contact with his family members who were also employed there, including his brother Errol who worked there from 1962 to 1997 and his brother Joseph who worked there from 1963 to 1997. The lawsuit claims that his secondary exposure came from both contact with his brothers and from washing and handling their clothes and other objects.

Citing Avondale’s, its’ officers’, and the other named defendants’ failures to reveal medical information, to reveal the dangers of asbestos, to provide necessary protections to all three brothers, and more, Errol and Mary Anne blame them for their father’s diagnosis on October 31st, 2024 and death less than two weeks later. They are asserting both survival and wrongful death claims on behalf of the family.
